Terms of use
These terms set out the basis on which you may use the Lienhouse website. The site is general information about raising capital secured against assets you already own; it is not an offer of credit, a financial product, or advice of any kind. Any funding proceeds only under separate written loan documents.
This website is operated by Lienhouse, a business name of Aston Social Pty Ltd (ABN [to confirm]) (“Lienhouse”, “we”, “us”). By accessing or using the site, you agree to these terms. If you do not agree, please do not use the site.
Lienhouse is a lending house that helps Australian companies and trusts raise capital secured against the assets they already own — primarily property. The site exists to explain how that works. It is general information, not personal advice, and not an offer.
About this website
Everything on this site is published for general information. It describes products, structures, indicative terms and the kinds of situations they suit. It does not take account of your particular circumstances, objectives or financial position, and it is not a substitute for advice from your own accountant, solicitor or other professional adviser.
We take care to keep the site accurate and current, but we do not warrant that it is complete, free of error, or up to date at the moment you read it. Where a figure or position matters to a decision, confirm it with us directly before you rely on it.
No offer and no advice
Nothing on this site is an offer to lend, an offer of a financial product, or an invitation to enter any facility. Nor is it financial, credit, legal or tax advice. Reading the site, or sending us an enquiry, does not create an adviser or client relationship between us.
Any funding only ever proceeds under separate written loan documents, prepared for your specific transaction and signed by both sides. Those documents — not this website — set out the binding terms, and the funding entity for your facility appears on them at execution, as it always does.
Business-purpose lending only
The lending described on this site is for business purposes, provided to companies and trusts. It is not consumer credit, and the site is not directed at borrowers seeking credit for personal, domestic or household purposes. By enquiring, you confirm that any funding you are seeking is wholly or predominantly for business purposes.
Making an enquiry
When you send an enquiry, please give us accurate information about the amount, the asset and the timeframe. We use it to assess whether and how we can help, and to scope a structure. Submitting an enquiry places no obligation on you, and it does not commit us to provide funding. Either of us is free to not proceed.
Indicative figures
Rates, loan amounts, terms and loan-to-value ratios shown on this site are indicative and representative of the current Australian market for this kind of lending. They are current as at the date shown on the relevant page and are always subject to assessment of your transaction. They are not a rate card, and the actual terms of any facility are confirmed in writing for your specific deal. See rates and fees for how we frame this.
Intellectual property
The content of this site — text, layout, graphics, and the Lienhouse name and marks — is owned by us or used with permission, and is protected by law. You may view and print pages for your own reference or to share with your adviser. You may not copy, republish, scrape, or use the content for any commercial purpose without our written consent.
Acceptable use
Use the site lawfully and as intended. Do not attempt to interfere with its operation or security, gain unauthorised access to any system, introduce malicious code, or use the site to send anything unlawful, misleading or harmful. We may restrict or withdraw access where use breaches these terms.
Linked websites
The site may link to third-party websites for convenience. We do not control those sites and are not responsible for their content, accuracy or availability. A link is not an endorsement, and your use of a linked site is governed by that site’s own terms.
Availability of the site
We aim to keep the site available, but we provide it on an “as is” and “as available” basis. We may change, suspend or withdraw any part of it without notice, and we do not guarantee uninterrupted or error-free access.
Liability
To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, this site or its content, including indirect or consequential loss.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that the law — including the Australian Consumer Law and the equivalent provisions of the ASIC Act — implies or imposes and that cannot lawfully be excluded. Where our liability can be limited but not excluded, it is limited, at our option, to supplying the relevant information or service again or paying the cost of having it supplied again.
Privacy
How we handle the information you give us is set out in our privacy policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. The current version is the one published here, with the date shown above. Continuing to use the site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of [State/Territory], Australia. You submit to the non-exclusive jurisdiction of the courts of that place.
