Privacy Policy
This policy explains how Lienhouse collects, uses, stores and discloses personal information, and how you can access it, correct it, or raise a concern. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Lienhouse helps Australian companies and trusts raise capital secured against assets they already own — primarily property. To do that, we collect and handle personal information about the people connected with those businesses, about the accountants and advisers who refer them, and about visitors to this website. This policy sets out how we manage that information.
In this policy, “Lienhouse”, “we”, “us” and “our” mean the business operating under the name Lienhouse (a business name of Aston Social Pty Ltd). “Personal information” has the meaning given in the Privacy Act 1988 (Cth).
The information we collect
We collect the personal information we reasonably need to assess an enquiry, structure a facility, and arrange and settle funding. Depending on your dealings with us, that can include:
- Identity and contact details — name, position or role, business name, email, phone and postal address.
- Information about the company or trust and the people behind it — directors, trustees, beneficial owners and any proposed guarantors.
- Financial and security details — the asset offered as security, existing finance held against it, the amount and purpose sought, and supporting documents you choose to provide.
- Referral details — where an accountant or adviser introduces you, the information they pass on to make the introduction.
- Website and technical data — pages viewed, device and browser information, and similar analytics collected when you use this site.
We only collect sensitive information where it is reasonably necessary and you have consented, or where the law otherwise allows it. We do not seek information we do not need.
How we collect it
We usually collect personal information directly from you — through the enquiry form, by email or phone, or in the documents you send us. We may also collect it from an accountant or adviser who introduces you with your knowledge, from public registers such as ABN Lookup or land titles, and from the third parties involved in assessing and settling a facility. Where it is reasonable and practicable, we collect information directly from the individual it concerns.
Why we collect, use and disclose it
We use personal information to respond to enquiries, assess and structure a proposed facility, arrange and settle the funding, meet our legal and regulatory obligations, keep our records, and improve this website. We may also use your contact details to send you relevant information about our services, and you can opt out of those messages at any time.
We disclose personal information only where it is needed for these purposes — for example, to the credit and funding providers, financial institutions, valuers, legal practitioners, settlement agents and other parties involved in assessing, structuring or settling a facility, and to our own professional advisers and service providers. We do not sell personal information.
Direct marketing
Any marketing message we send will identify Lienhouse and give you a simple way to opt out. If you ask us to stop, we will. We do not use or disclose your personal information for another organisation’s direct marketing.
Overseas disclosure
Some of the service providers we rely on — for example, cloud hosting or analytics — may store or process data on servers located outside Australia. Where that happens, we take reasonable steps to ensure the information is handled consistently with the Australian Privacy Principles. Cookies and website analytics
This website uses cookies and similar technologies to keep the site working, understand how it is used, and improve it. You can set your browser to refuse cookies, though some parts of the site may not work as intended if you do. Analytics data is used in aggregate and is not used to identify individual visitors.
How we keep it secure
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. This includes technical and organisational measures appropriate to the information we hold. No system is completely secure, so we cannot guarantee absolute security, but we work to keep the information we hold protected and to hold it only as long as we need it.
Data breaches
If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme under the Privacy Act — containing the breach, assessing it, and notifying affected individuals and the Office of the Australian Information Commissioner where the scheme requires it.
Automated decision-making
Lienhouse does not use automated processing to make decisions that have a significant effect on individuals — a person reviews each enquiry and assessment. If that changes, we will update this policy to explain how automated decision-making is used, consistent with the transparency obligations under the Privacy Act.
Accessing and correcting your information
You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Contact our privacy officer using the details below. We will confirm your identity before acting on a request, respond within a reasonable period, and let you know if there is any reason we cannot give access or make a correction.
Making a complaint
If you think we have mishandled your personal information, please contact us first so we can look into it and put things right. We will acknowledge your complaint and respond within a reasonable period. If you are not satisfied with our response, you can take your complaint to the Office of the Australian Information Commissioner at oaic.gov.au.
Changes to this policy
We may update this policy from time to time to reflect changes in our practices or the law. The current version is always the one published here, with the date it was last updated shown at the top of the page.
